H.B. 1847 of the 114th General Assembly was approved by the Governor on May 7, 2026 and assigned Public Chapter 961 by the Secretary of State on May 18, 2026, the Senate having substituted it for its companion S.B. 2128.
H.B. 1847 of the 114th General Assembly was approved by the Governor on May 7, 2026 and assigned Public Chapter 961 by the Secretary of State on May 18, 2026, the Senate having substituted it for its companion S.B. 2128. The legislature titles it: AN ACT to amend Tennessee Code Annotated, Title 5; Title 6; Title 7; Title 13 and Title 65, relative to data centers. What it requires was read from Public Chapter 961 as filed with the Secretary of State.
What it requires

A municipality or an electric utility may not pay, or otherwise absorb, the cost of the electrical infrastructure built to serve a data center, which the act defines as a building mainly holding equipment that processes, stores or transmits digital information together with the environmental control equipment that equipment needs, and projected to reach a peak electric demand of 50 megawatts or more in its first three years; a state facility and a telecommunications or broadband network facility are not data centers for this purpose. A utility may put part of that cost to general system improvements only where the work goes beyond what the data center needs, can serve others without cutting existing service, and is allocated under policies that are not written for data centers alone; it may reimburse a data center for infrastructure the data center paid for only under standard policies that reach comparable customers, treat a data center no better than them, and do not raise existing customers' rates. A data center may buy electricity, capacity or related services from an independent power producer in the state: behind its own meter where it takes no utility service, behind the meter with the utility's written approval where it does, or across transmission and distribution at the owner's election and on the owner's terms. Such a producer is not a public utility merely for selling to a data center that way. Where the act conflicts with a term, rate schedule or requirement of the Tennessee Valley Authority, the Authority's term controls.
2 rows stand behind this one rule: where both chambers passed the same measure, each chamber's act keeps its own row, its own line in the CSV and the JSON, and its own chapter where it has one, and the two are named together here.
A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
