Corporation Commission; creating the Data Center Customer Ratepayer Protection Act of 2026; effective date; emergency.
Passed
H.B. 2992 of the 2026 Regular Session was signed on May 11, 2026. The legislature titles it: Corporation Commission; creating the Data Center Customer Ratepayer Protection Act of 2026; effective date; emergency.
What it requires
A large load customer, meaning a new data center, a new cryptocurrency mining operation or a new facility whose main function is artificial intelligence computing that contracts to add 75 megawatts or more of load per facility, or in aggregate behind one point of interconnection, after July 1, 2026, is now a class of its own.
Any body that reviews electric supplier rates, the Corporation Commission, a municipal governing body or a cooperative's board of trustees, must see that residential, commercial and industrial customers are protected from unjust rates arising from service to such customers, and must allocate costs and revenues by cost causation. Every retail electric supplier in the state must keep separate terms and tariffs for large load customers, including credit requirements and measures ensuring they reimburse the costs allocated to them, unrecovered costs included where a customer leaves or cuts load, with a term of service of at least ten years. A large load customer, or anyone buying land for it outside an industrial park or a municipality, must notify the Corporation Commission, the county commissioners and every abutting owner by certified mail within 60 days of the purchase, on pain of $1,500 a day for each violation.
A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
