Construction of data center by foreign adversary.
Passed
S.B. 431 of the 2025 Regular Session was signed on April 10, 2025. The legislature titles it: Construction of data center by foreign adversary.
What it requires
After June 30, 2025 a foreign company may not build a data center in Indiana, or have one built, unless the utility regulatory commission and the economic development corporation first study the electricity the prospective data center is expected to use and certify to the Governor and the General Assembly that the estimated electricity will be self generated and will not affect...
After June 30, 2025 a foreign company may not build a data center in Indiana, or have one built, unless the utility regulatory commission and the economic development corporation first study the electricity the prospective data center is expected to use and certify to the Governor and the General Assembly that the estimated electricity will be self generated and will not affect the load supply of MISO or PJM. A foreign company is one at least half owned by a foreign adversary as defined in 15 CFR 791.2, or headquartered in a country whose government is such an adversary, and the bar reaches a subsidiary, a parent and an affiliate alike. The act sets no megawatt or square footage threshold: it reaches any facility meeting the chapter's definition of a data center.
A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
