  • S. 484 Statute

    Data Centers

Passed passed May 8, 2026. 2026 Regular Session. This status is read from the bill's own record, not written here.

    S. 484 of the 2026 Regular Session was signed on May 8, 2026. The legislature titles it: Data Centers.

By October 1, 2026 every public utility other than a gas utility must file a tariff for the Public Service Commission's approval whose terms reasonably ensure that each large load customer bears its own full cost of service, connection, incremental transmission and generation, other infrastructure and operations included, that the general body of ratepayers does not carry the risk of nonpayment, and that the utility does not serve a large load customer which is a foreign entity. A large load customer is one with an anticipated monthly peak load of 50 megawatts or more at a single location, and a customer may not split a load at one location into smaller connections to fall below it. No tariff, contract or utility policy may hinder curtailment of a large load customer where that is meant to hold the grid stable, limit an outage or protect public safety. A water management district or the Department of Environmental Protection may not issue a consumptive use permit to a large scale data center where the use would harm the area's water resources or is barred by local zoning, may not approve one without a hearing, and must require reclaimed water in place of surface water or groundwater where the act's conditions are met; an application for an average of 100,000 gallons a day or more must come with every source, amount and loss of water and a conservation plan. The act also orders an independent study of large scale data centers, due to the Governor and the Legislature by July 1, 2027.

A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
