Electric Utilities; review by Public Service Commission of certain contracts with large load data centers further provided for

Passed passed April 17, 2026. 2026 Regular Session. This status is read from the bill's own record, not written here.

S.B. 270 of the 2026 Regular Session was signed on April 17, 2026. The legislature titles it: Electric Utilities; review by Public Service Commission of certain contracts with large load data centers further provided for.

    What it requires

The act tells the Public Service Commission how to judge a retail electric service contract between a utility and a large load data center customer, which it defines as a customer contracted to take an expected peak demand of 150 megawatts or more on contiguous parcels and operating solely for data processing.

The act tells the Public Service Commission how to judge a retail electric service contract between a utility and a large load data center customer, which it defines as a customer contracted to take an expected peak demand of 150 megawatts or more on contiguous parcels and operating solely for data processing. Such a contract is consistent with the public interest where the commission finds that its pricing and terms are expected to recover the incremental costs of serving that customer from that customer, fuel and taxes included, and to promote positive benefits to the utility's other retail customers. The act names what counts as a positive benefit: lower costs for other customers, greater efficiency of the utility's power system, and economic growth where the premises sit. It sets no filing deadline, no reporting duty and no obligation on the data center itself.

A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
