- S.B. 312 Statute
An Act To Amend Title 9, Title 22, And Title 29 Of The Delaware Code Relating To Data Centers.
Passed
S.B. 312 of the 153rd General Assembly was signed on August 26, 2026. The legislature titles it: An Act To Amend Title 9, Title 22, And Title 29 Of The Delaware Code Relating To Data Centers.
What it requires
The act forbids a county, a municipality and a state agency each from entering a nondisclosure agreement that restricts it from telling the public about potential or actual large scale data center development. A large scale data center is one that uses or is able to use 100 megawatts of power or more.
The act forbids a county, a municipality and a state agency each from entering a nondisclosure agreement that restricts it from telling the public about potential or actual large scale data center development. A large scale data center is one that uses or is able to use 100 megawatts of power or more. A nondisclosure agreement is read widely: any contract, clause, term, condition or understanding, written or spoken, whose purpose or effect is to restrict disclosure, naming confidentiality agreements, secrecy provisions, side letters, memoranda of understanding and settlement agreements. An agreement that violates the act is against public policy and is void and unenforceable. The act sets no filing duty, no deadline and no obligation on a developer.
A law here is one statute, utility commission order, tariff, tax rule, moratorium or bill at the state level. What it requires is taken from the text, never summarized from coverage; a date the text does not give is left empty. Its status is one of five, defined on the laws index. The dated events beneath a law are the scorecard entries that cite it.
