The bill would add to the definition of a qualifying cogenerator in Section 31.002 of the Utilities Code an owner or operator of dispatchable generation that supplies thermal, steam or waste heat to a colocated desalination facility and serves a large electric load. The bill text describes the electric load as one whose primary purpose is the manufacture of digital products. The statute the bill would write does not use the words data center. The House State Affairs Committee analysis describes the projects as combining power generation, desalination, and data centers.
